"When this outrageous incident happened, it became clear that in addition to obtaining damages for our clients (which we are still working on), we had a unique opportunity to force the Oakland Police Department to fundamentally change how it deals with all types of crowds.  The OPD moved a long way from its original position, and now we have a good written policy, with at least three years of court oversight.  The test will be to see how well the policy is followed - and to hold them to it if it is not."

  • City of Canton Ohio v. Harris
    The United States Supreme Court held that a City’s failure to train police officers may state a municipal liability claim under Sec. 1983.
  • Sterling v. City of Minersville
    The Third Circuit found there was a constitutional right to privacy including the right not to have intimate facts concerning one's life disclosed. The court held a police officer violated this right by threatening to disclose the officer’s belief that the person was gay. The officer was not entitled to qualified immunity.
